(“Qonscious Health,” “we,” “us,” or “our”) collects, uses, shares, and protects your personal information when you visit our website, use our mobile application, participate in our health and wellness programs, or engage with our services. By accessing our website, downloading our app, or using our services, you consent to the practices described in this policy.
Because our platform collects health-related information, we take your privacy with particular seriousness. Please read this policy carefully.
1. Information We Collect
We collect several categories of information depending on how you interact with our services:
A. Information You Provide Directly
- Personal Identifiers: Name, email address, phone number, billing address, and account credentials.
- Payment Information: Credit card and billing details, processed securely through third-party payment providers. We do not store full payment card numbers.
- Health and Wellness Data: Health goals, lifestyle habits, nutrition information, exercise activity, emotional and behavioral assessment responses, and progress data you choose to share through the app or our coaching programs.
- Assessment Responses: Responses to the QBOS battery assessments across the six domains: Cognitive Clarity, Motivation Drive, Emotional Balance, Stress Resilience, Metabolic Rhythm, and Energy Systems.
- Communications: Emails, in-app messages, coaching session notes, and feedback you provide.
- Employer-Sponsored Enrollment: If your employer has enrolled you in Qonscious Health as part of a benefits program, we may receive your name, email, and enrollment status from your employer or benefits administrator.
B. Information Collected Automatically
- Usage Data: How you interact with the website and app, including pages viewed, features used, session duration, and navigation patterns.
- Device Information: IP address, device type, operating system, browser type, and unique device identifiers.
- Location Data: General location information derived from IP address, or precise GPS location if you grant permission.
- Crash and Performance Data: Technical data used to identify and resolve app errors and performance issues.
C. Health Data from Device Integrations
With your explicit consent, our mobile app may access health and fitness data from your device through Google Health Connect or Apple HealthKit. The specific data types we request are limited to:
- Sleep Session data
- Body Temperature
- Heart Rate
- Resting Heart Rate
This data is used solely to support your personalized wellness experience within the Qonscious Health platform. We do not sell or share this data with third parties for advertising purposes. You can revoke this access at any time through your device settings.
D. Research Participation Data
If you participate in a Qonscious Health clinical study or research program (including our partnership with TCOYD and affiliated institutions), additional data may be collected as described in the informed consent document provided at the time of enrollment. Research participation is always voluntary.
2. How We Use Your Information
We use the information we collect for the following purposes:
- To deliver, personalize, and improve our coaching, wellness platform, and mobile app services.
- To calculate and display your QBOS scores and generate personalized health insights.
- To power QBOS Coach, our AI-based coaching companion, which uses your behavioral and health data to provide Socratic, goal-oriented guidance.
- To process payments, manage subscriptions, and administer your account.
- To communicate with you about your account, program progress, and service updates.
- To send promotional communications and program recommendations (you may opt out at any time).
- To conduct research and improve our platform, assessments, and methodology.
- To comply with legal obligations and protect our rights and the rights of others.
- To fulfill employer-sponsored program administration obligations where applicable.
3. Sharing of Your Information
We do not sell your personal information or your health data. We may share information in the following limited circumstances:
- Service Providers: Third-party vendors who assist us with payment processing, cloud hosting, email delivery, push notifications, analytics, crash reporting, and app functionality. These vendors are bound by contractual data protection obligations.
- Employer Sponsors: If your access to Qonscious Health is provided through your employer, we may share aggregate, de-identified program participation and outcomes data with your employer to support program administration. We will not share your individual health data with your employer without your explicit consent.
- Research Partners: Where you have provided informed consent for research participation, de-identified or consented data may be shared with our academic and clinical research partners, including institutional review board-approved studies.
- App Store Providers: Apple App Store and Google Play Store, as required for app distribution and Health Connect integration.
- Business Transfers: In the event of a merger, acquisition, or sale of all or substantially all of our assets, your information may be transferred as part of that transaction. We will notify you of any such change.
- Legal Compliance: When required by law, regulation, court order, or to protect the rights, safety, or property of Qonscious Health, our users, or the public.
4. Health Data and Sensitive Information
Qonscious Health collects health-related information as described above. While Qonscious Health is not currently a Covered Entity under HIPAA, we treat all health and wellness data with the same care and sensitivity we would apply to protected health information. Specifically:
- We do not sell health data.
- We do not use health data for advertising or marketing profiling.
- We do not share individual health data with employers without explicit consent.
- Health data collected through device integrations is used exclusively to support your in-app experience.
- AI-generated coaching insights from QBOS Coach are for informational and motivational purposes only and do not constitute medical advice.
5. Your Rights Under California Law (CCPA/CPRA)
If you are a California resident, you have the following rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA):
- Right to Know: You may request information about the categories and specific pieces of personal information we have collected about you, the sources of that information, our business or commercial purposes for collecting it, and the categories of third parties with whom we share it.
- Right to Delete: You may request that we delete personal information we have collected from you, subject to certain exceptions required by law.

If we become aware that we have collected personal information from a person under 18 without verifiable parental consent, we will take steps to delete that information promptly. Our website and app may contain links to third-party websites or integrate with third-party services (including wearable device platforms, payment processors, and employee benefits portals).
